Thoughts for the Day, September 2, 2021: I am starting a new business. I am excited.

The Texas legislatures showed their creativity with the passage of an anti-abortion bill that gets around federal abortion laws which forbid states from banning abortion before a fetus reaches viability so federal judges blocked those laws from taking effect. (Roe v. Wade, the 1973 decision that established a constitutional right to abortion, and Planned Parenthood v. Casey, the 1992 decision that affirmed that right)

Per multiple news sources, the Texas law, which provides no exception for rape or incest, was designed to avoid constitutional challenge. Plaintiffs seeking to block a law on constitutional grounds would usually name state officials as defendants. But the Texas law bars state officials from enforcing it, effectively circumventing Roe v. Wade. Instead, the law deputizes private individuals — including individuals outside Texas — to sue anyone who performs the procedure or “aids and abets” itThe patient may not be sued, but doctors, clinic staff, counselors, people who help pay for the procedure, even an Uber driver who takes a patient to an abortion clinic all could be. Plaintiffs, who do not need to have any connection to the abortion at issue, are entitled to at least $10,000 and attorney’s fees. Defendants, on the other hand, have to pay their own way even if they win.
This new Texas law has got me thinking about starting an LLC in Texas in order to supplement my retirement.  My plan is to hire undercover employees of clinics, hospitals, counseling services, Planned Parenthood, etc.  I will contract with them to identify doctors, clinic staff counselors, family members and Uber/Lyft drivers who assist or perform abortions or who help the patient by providing transportation to and from the clinics or help the patient pay for the abortion. I will handle all legal costs so there is no risk to the contractors. If I win my lawsuit, I will pay the contractor $3,000 for each case I win.  That will leave $7,000 for me.  My legal cost will be paid if I win the case.  As I become more experienced in this new endeavor, I will be able to determine upfront winnable cases.  This will allow me to minimize risk of unnecessary legal cost.   With a state as populous as Texas, I will have plenty of opportunity.  I will start my efforts in low income and minority areas where everyone knows abortions are rampant.  I will gradually expand to college health facilities and private clinics in college towns.   I easily see me winning over 100 cases per year once I get this fully operational.  That will give me $700,000 annual minus operating expenses.  I think this is a brilliant idea.  I cannot wait to run it by Leah in the morning and see what she thinks.  She shouldn’t have a problem with this because I should be able to do most of this remotely.  Tomorrow I plan on drafting a business plan for my new LLC.  Once my business plan is completed and I get Leah’s approval, I am going to figure out a way I can profit from the new Texas law which makes if makes it more difficult to vote. I am thinking that I can use my contractors to register to vote those seeking abortions and those assisting them.   There should be plenty of opportunity in low income and minority areas because we all know most of “these people” never register to vote because they do not care. I will probably be able to get the local Democrats to pay me under the table $50 per person for each person I register.   On election days, I will hire Uber drivers and pay them $15 to take the person I registered to vote to and from the polling areas. I am sure the Democrats will pay me another $100 for every person I take to the polls.  I will also ask my Uber drivers to strike up a conversation with the citizens they are taking to and from the polling areas to see if we can get new intelligence on any of their friends and family members who recently had an abortion.  Since the Democrats are experts in carrying out election fraud, I have no concerns about getting caught doing anything that is illegal.  They also are very good at covering their tracks when it comes to campaign expenses so I am not worried about any paper trail leading to me.  Since all of the payments from the Democrats will be in cash and under the table, I will not be filing it as income on my tax return. I cannot wait until tomorrow to get started on this.  I am sure Leah will not have any problem with being an officer in my LLC.  I hope you have enjoyed my above parody.

Stay safe.  Wear your mask. Wash your hands regularly.  Social distance when indoors.  Schedule your vaccine and booster when it becomes available.

Orchid of the Day: All of the first line workers who are dealing with Covid-19 and hurricane Ida.  We owe you.

Onion of the Day: The Texas legislature for passing a law that works around existing federal laws, provides no exception for incest and rape, encourages private citizens to become vigilantes and has no respect for a women’s right to choose what is right for herself.  This  is coming from a state legislature who doesn’t feel government has the right to tell people they need to wear a mask.

Quote of the Day: “It’s completely inverting the legal system. It says the state is not going to be the one to enforce this law. Your neighbors are.”  Stephen Vladeck, a constitutional law professor at the University of Texas at Austin
